Article 5 - Availability of Goods

The availability of products is indicated in the description. In the event of a product being unavailable after validation of your order, we will inform you by email. In the case of stock depletion, CSI will inform the customer as soon as possible. In agreement with the customer, CSI will propose to replace the depleted vintage with an equivalent vintage in the case of a wine purchase with a personalized label.

Article 6 - Delivery

The products are delivered to the address indicated by the customer when placing the order.
The customer chooses from the following delivery methods:

  • Economical: estimated delivery within 10 to 14 working days (the date displayed is indicative only, with no guarantee of delay).

  • Standard: estimated delivery within 5 to 7 working days (the date displayed is indicative only, with no guarantee of delay).

  • Express: express delivery within 2 to 3 working days with a guaranteed date from the carrier (Chronopost or equivalent).

The dates displayed during the order are automatic estimates calculated based on average production and transshipment times.
Only the Express option benefits from a firm deadline guarantee.

When the customer has explicitly indicated an essential date (event dated) acceptable to CSI, any delay making the good useless opens the right to resolution and reimbursement.

Legal Responsibility
In accordance with articles L.216-1 and following and L.221-15 of the Consumer Code, CSI remains fully responsible for the proper execution of the delivery.
In case of delay:

  • the customer may request delivery within a reasonable additional period,

  • and, if it does not occur, resolve the sale and obtain a full refund within 14 days (art. L.216-2 and L.216-3).

The indicated delivery deadlines are adhered to as far as possible. However, a delay in delivery only opens the right to resolution of the contract if it is deemed substantial or renders the good useless (event dated).

Option "Delivery Insurance"
The customer may subscribe, at the time of their order, to an option "Delivery Insurance" which guarantees a full refund of the order in case of loss or delay making the order useless (e.g., dated event).
Without this option, customer compensation is limited to that provided by the carrier, subject to their legal rights.

Particular Cases

  • If the package is found after reimbursement, the customer agrees to refuse the package or return it to CSI, with return costs covered by CSI.
  • Costs related to an incorrect address or absence of the recipient will be charged to the customer.
  • For Switzerland, customs duties and taxes remain the responsibility of the customer.
  • In case of force majeure (strike, bad weather, pandemic, blockage of transport, etc.), delivery times may be suspended without engaging CSI's responsibility.

Article 7 - Right of Withdrawal

According to article L.221-28 of the Consumer Code, the right of withdrawal does not apply to goods made according to the specifications of the consumer or clearly personalized. Consequently, no right of withdrawal is open for products sold on this site.

Article 8 - Retention of Title

The merchandise remains the property of CSI until full payment of the invoice, in accordance with the terms of law no. 80 336 of May 1, 1980, concerning the retention of title.
However, the risks (loss, theft, deterioration) are transferred to the customer upon physical delivery of the products.

The customer is required to verify the condition of the products upon delivery and to make any reservations with the carrier.

Article 9 - Claims

Any claim concerning problems of breakage, loss, or theft of all or part of a shipment must be made validly at the time of delivery to the carrier, by an express mention on the delivery slip, and then confirmed to us by written form (mail or email) within 48 hours. After agreement from our services, missing or damaged merchandise will be replaced free of charge.
Our teams take particular care in creating, printing, and preparing your labels. A quality control checks all prints.
However, if you notice an anomaly on your labels not inferring to article 11, you may make a claim by sending an email to contact (@) votre-etiquette.com, indicating clearly the defect(s) observed. Note: in the event of reprinting, you will be required to return all defective labels so we can identify the problem.

To allow CSI to exercise its remedies against the carrier (Chronopost, Colissimo, La Poste), the customer must report any loss, damage, or delay within the following periods from the expected delivery date:
  • 48 hours for a Chronopost shipment
  • 5 days for a Colissimo shipment
  • 30 days for a standard shipment

These reporting deadlines condition compensation by the carrier and therefore the possibility for CSI to compensate the customer.

However, irrespective of these procedural deadlines, the customer retains the benefit of legal guarantees of conformity (articles L.217-3 to L.217-20 of the Consumer Code) and hidden defects (articles 1641 and following of the Civil Code).

In case of a lost or damaged parcel, compensation will be limited to the amount effectively covered by the carrier, unless the customer subscribed to the "Delivery Insurance" option at the time of their order.

Article 10 - Quality and Printing

All prints are made exclusively from the electronic files created by the customer in the label editor. Consequently, the print is strictly identical to the customer's composition and it may happen that a variation in color, contrast, or pixelation appears in printing. These characteristics are minor and are quite normal.

Any claims concerning color variations, even from one order to another strictly identical, cannot give rise to a refund or indemnity. Colorimetry being complex and influenced by the rendering of the client's screen, the exporting of files, the type of paper, and the machine settings, we ask our customers who wish for a specific color rendering to contact VOTRE-ETIQUETTE.COM by email or phone. They can then provide a RAL or PANTONE identification of the required colors. This will allow VOTRE-ETIQUETTE.COM to establish a colorimetric profile and adjust the machines closely to the specifications, although we cannot guarantee perfect accuracy.

Article 11 – Legal Guarantees

The consumer benefits by right:

  • from the legal guarantee of conformity (articles L217-3 to L217-20 of the Consumer Code), valid for 2 years from the delivery of the good,

  • from the legal guarantee against hidden defects (articles 1641 to 1649 of the Civil Code).

CSI remains liable for these guarantees regardless of any commercial guarantee.

Article 12 - Data Confidentiality

In accordance with the GDPR and articles 39 and 40 of law no. 78-17 of January 6, 1978, modified relating to information technology, files, and freedoms, you have the right to access, rectify, and delete personal data about you. You can exercise this right by contacting the publishers of the website VOTRE-ETIQUETTE.COM at the above coordinates or by email via our contact form.
